General terms and conditions of the Old Town Dental Practice Membership Plan

 

1. Introduction

1.1 These terms and conditions are the terms and conditions which apply to the Old Town Dental Practice Membership Plan.

1.2 The Membership Payment Plan is a scheme to provide preventative dental treatment over a twelve month period and to provide additional discounts and / or benefits to plan members as described in the current Old Town Dental Practice Membership Plan leaflet.

1.3 The Dental Plan can only be taken out on a Direct Debit. We cannot accept credit card payments, except the initial joining fee which is only payable at the Old Town Dental Practice.

1.4 The Dental Plan is available at the Old Town Dental Practice but is not available at all other practices.

2. Commencement, Duration & Cooling off period

2.1 By entering into a plan members are, subject to the cooling off period (as per clause 2.3), committing to a minimum membership period of 12 months.

2.2 Plan members are entitled to the benefits of their plan from the date their application is accepted by the OTDP practice until the plan is terminated by either party.

2.3 Plan members have a 14 day cooling off period from the date they sign their Dental Plan application form in which to cancel their plan. If a plan member cancels within this 14 day period any contribution they have paid will be refunded in full provided they have not already benefited from any of the benefits available under the plan.

2.4 Plan members may not be able to book appointments if there is a balance outstanding on the account. This will need to be settled before  appointments can be booked.

3. Renewals and alterations

3.1 Following the initial 12 month membership period, the member’s plan is thereafter automatically renewed on an ongoing basis. OTDP will not send a plan member new documentation at renewal unless we have varied or made changes to the plan’s premiums, terms and conditions or benefits.

3.2 Following the initial 12 month membership period, 1 month notice is required from a plan member to terminate their plan membership. The renewal date will be 12 months from the date the plan member took out the plan and this date should be specified on your signed agreement.

3.3 OTDP reserves the right to vary or make changes to the plan, these terms and conditions, and the benefit levels applicable to each plan after giving 30 days’ notice of any such proposed changes. Any changes will be published on the OTDP website.

4. Transferability of Plan benefits

Whilst OTDP’s Membership Payment Plans are not transferable to third parties, plan members are entitled to receive their benefits under their membership plan at Old Town Dental Practice.

5. Notices

All notices under this agreement will be sent by e-mail to the last known e-mail address of the plan member.

6. Third party rights

A person who is not a party to this contract has no rights under the Contracts (Right of Third Parties) Act 1999 to enforce any of these terms and conditions or the provisions of the Policy Document.

7. Governing Law

These terms and conditions and the policy document shall be governed by and construed in accordance with the laws of England and Wales and will be subject to the exclusive jurisdiction of the English Courts.
